Terms of Service – Organisers

1. Overview

These Organiser Terms of Service govern the use of the Eklavya platform by organisers who create, list, promote, and sell tickets for events, trips, and experiences through the platform.

By applying to join, registering as an organiser, submitting listings, or selling tickets through the platform, you agree to be bound by these Terms, the Privacy Policy, the Refund & Cancellation Policy, and any related policies published by Eklavya Group.

2. Organiser Eligibility

To use the platform as an organiser, you must have the legal authority to organise, market, and sell tickets for the events or trips you submit. You must provide accurate and complete information during registration and maintain updated organiser details at all times.

Eklavya Group reserves the right to approve, reject, suspend, or remove organiser accounts at its sole discretion.

3. Organiser Responsibilities

Organisers are solely responsible for:

  • the accuracy of event or trip listings;
  • compliance with all applicable laws, licensing, permits, insurance, and safety obligations;
  • the operation and delivery of the event or trip;
  • all representations made to customers;
  • customer-facing event communications;
  • handling event fulfilment in a professional and lawful manner.

Eklavya Group acts as a platform provider and does not assume responsibility for the organiser’s legal or operational obligations.

4. Event Listings

Organisers may submit events, trips, or experiences for publication on the platform. Eklavya Group may review, edit, refuse, remove, suspend, or restrict any listing where it considers such action necessary for quality control, legal compliance, safety, reputational protection, or platform policy enforcement.

Organisers must ensure that all listing information is clear, accurate, and not misleading.

5. Commission Structure

Event and trip listings may be published on the platform without upfront listing fees.

Eklavya Group charges the following fees on ticket sales:

  • 5% platform fee on the total value of ticket sales for the relevant event or trip; and
  • £0.25 booking fee per ticket sold (Collected from customers on check out as a booking fee)

Applicable fees shall be deducted from ticket revenue prior to payout.

Eklavya Group reserves the right to amend its commission structure at any time upon reasonable notice.

6. Payment Processing

Customer payments are processed using Shopify Payments and related payment infrastructure used by the platform. Organisers acknowledge that payment processing timelines, fund availability, reserves, verification checks, and related issues may be affected by third-party payment providers.

Eklavya Group does not guarantee uninterrupted payment services.

7. Payout Policy

Subject to verification, fraud checks, disputes, and policy compliance, organiser payouts are intended to be released at the earlier of:

  • when all available tickets for the event or trip are sold; or
  • 48 hours before the scheduled start date and time of the event or trip.

All payouts are made by bank-to-bank transfer only.

The organiser is responsible for providing accurate banking details. Eklavya Group shall not be responsible for failed or delayed payouts caused by inaccurate, incomplete, or outdated banking information.

8. Delayed, Withheld, or Suspended Payouts

Eklavya Group reserves the right to delay, withhold, offset, or suspend payouts where reasonably necessary, including in cases involving:

  • suspected fraud;
  • chargebacks or payment disputes;
  • refund investigations;
  • customer complaints;
  • regulatory or legal concerns;
  • breach of these Terms or other platform policies.

9. Refunds and Customer Claims

Organisers acknowledge that ticket sales are subject to the platform’s Refund & Cancellation Policy and any event-specific terms approved by Eklavya Group.

Where a refund, chargeback, or compensation claim arises from organiser conduct, event cancellation, misrepresentation, operational failure, or breach of obligations, Eklavya Group may deduct relevant amounts from current or future payouts or seek reimbursement directly from the organiser.

10. Prohibited Conduct

Organisers must not:

  • submit false, inaccurate, or misleading listings;
  • sell tickets for unlawful, unsafe, or unauthorised events;
  • misuse customer information;
  • engage in deceptive pricing or hidden charges;
  • circumvent platform fees or direct customers away from the platform to avoid commission;
  • use the platform in any way that may harm customers, the brand, or other users.

11. Intellectual Property and Brand Use

Eklavya Group retains all rights in its platform, brand, logos, design, and technology. Organisers may not use Eklavya Group branding except as expressly permitted for approved promotional use relating to their listing on the platform.

By uploading event content, organisers grant Eklavya Group a non-exclusive, royalty-free licence to use, reproduce, display, publish, and promote such content for the operation and marketing of the platform.

12. Suspension and Termination

Eklavya Group may suspend, restrict, or terminate any organiser account or listing immediately where it believes there has been:

  • a breach of these Terms;
  • fraud or suspected fraud;
  • reputational risk;
  • customer harm;
  • legal or compliance risk.

Termination does not affect any accrued rights, outstanding liabilities, deductions, or obligations owed to Eklavya Group or customers.

13. Disclaimer and Limitation of Liability

The platform is provided on an “as is” and “as available” basis. Eklavya Group does not warrant uninterrupted access, continuous availability, or guaranteed ticket sales.

To the fullest extent permitted by law, Eklavya Group shall not be liable for indirect or consequential losses, including lost profits, loss of bookings, reputational harm, or event-related losses arising from use of the platform.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales, and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
